We have tried to keep our Terms and Conditions of Booking as simple as possible, we realise nobody likes the small print!
“BCF” means the Company – Brighton Charter Fishing Limited.
“Customer” means the person, company or organisation booking a trip.
“Fee” means the cost of the trip as published on the BCF website or otherwise agreed in writing.
1.1 A booking will be provisional until BCF receives the following:
a. Deposit or Payment as defined in Section 2 below.
b. Customer name, address, telephone number, email address and date of trip, which the Customer provides at the shopping cart.
1.2 Upon receipt of the above BCF will confirm the booking by email.
1.3 These Terms and Conditions of Booking apply to all bookings confirmed to a Customer by BCF and by entering into a confirmed booking the Customer agrees to be bound by them (unless otherwise agreed in writing).
1.4 A copy of these Terms and Conditions of Booking is available on the BCF Company Website.
2. DEPOSIT OR PAYMENT
2.1 A deposit of £150 is required for booking the whole boat. The remainder of the Fee is payable on the day.
2.2 On the day we can only accept cash as payment for the remainder of the Fee, no cheques or credit cards.
2.3 For Individual Bookings £50 is payable at the time of booking (or £40 for half day) and the balance (if any) is payable in cash on the day.
3. GIFT VOUCHERS
3.1 Gift Vouchers are valid for 12 months from the date of purchase and CANNOT be refunded.
3.2 There is no cash alternative if the recipient chooses a trip to a lower cost than the Voucher value, or does not redeem their Voucher.
3.3 The Voucher can be redeemed against a more expensive trip, the difference to be paid on the day.
3.4 Our trips get booked up quickly on a first come first served basis, especially in summer. Therefore it is best for the recipient to get a date booked in promptly upon receipt of their Voucher.
3.5 All trips are weather dependant and if the sea is too rough the trip will be postponed. In this event the recipient can simply choose another available date.
4. CANCELLATION BY CUSTOMER
4.1 More than 4 weeks before the booked date then the Deposit or Payment is refunded.
4.2 Less than 4 weeks before the booked date then the Deposit or Payment is forfeited.
4.3 Less than 2 weeks before the booked date then the full Fee is payable.
4.4 If the Customer requests an early return to harbour then the full Fee is payable.
4.5 The Customer may change the date of their trip with a minimum of 2 weeks notice.
5. CANCELLATION BY BCF
5.1 Due to bad weather either the previous day or on the morning of the trip, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.
5.2 Due to illness, mechanical breakdown or other unforeseen circumstances, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.
5.3 BCF cannot be held liable for any consequential loss incurred by the Customer if BCF has to cancel the trip.
5.4 BCF will await written instruction from the Customer to reschedule or refund the Deposit or Payment if the trip cancelled by BCF.
5.5 Please allow up to 28 days for the refund of your Deposit or Payment to be processed, especially during busy times when the boat is mostly at sea.
5.6 BCF can refund the Deposit or Payment without incurring Fees up to 6 months from the transaction date. If a refund is requested by the Customer beyond 6 months of the transaction date a Fee of 5% (five percent) will be deducted by BCF and our payment processor (PayPal) may also deduct a Fee to the customer which is outside of BCF’s control.
6. WEATHER AND CONDITIONS
6.1 The Customer MUST telephone BCF the evening before the trip between 5.00 to 7.00pm to check the weather is suitable for the trip to go ahead and finalise details. Telephone 07850 171722
6.2 Failure to telephone will be taken as acceptance by the Customer of any decisions made by BCF for the following day.
6.3 BCF’s decision is final with regard to the weather but we try to get out if possible with due regard to safety and common sense.
6.4 BCF reserves the right to alter the planned trip with regards to weather and fishing conditions, for example a wreck fishing trip may have to become an inshore Plaice or Bream trip in the event of strong onshore winds or algae bloom. Stag, Hen and Boat Trips or Ash Scatterings may continue within the shelter of Brighton Marina. The Skippers decision is final in these matters.
7. ALCOHOL, DRUGS AND SAFETY
7.1 Due to changes in insurance company requirements only a small quantity of low strength alcohol will be allowed on board and always at the discretion of the Skipper.
7.2 The use of illegal Drugs is strictly prohibited. Drug abuse or excessive alcohol consumption will cause an immediate return to port and BCF may alert the relevant authorities if deemed necessary.
7.3 Any injury or loss sustained on board must immediately be reported to the Skipper.
7.4 Children under 14 years old are only taken by prior agreement by BCF in writing.
7.5 BCF’s Vessel, GREY VIKING II is licensed for a maximum of twelve passengers and two crew.
7.6 Any medical conditions that might affect a customer during the trip MUST be reported to the Skipper before departure.
8. INSURANCE AND LEGAL
8.1 Anything you catch you can keep if above the legal minimum landing size and not subject to a landing ban. In the interests of conservation at BCF we practise the return of all Conger Eels and most Rays.
8.2 It is illegal to sell any fish caught on board.
8.3 BCF’s Vessel and Skipper are licensed to operate as required by the MCA – Maritime and Coastguard Agency.
8.4 BCF maintains £2 million Public Liability Insurance.
8.5 These Terms and Conditions of Booking and all other express and implied terms of the contract shall be governed and construed in accordance with the laws of England and the parties agree to submit to the jurisdiction of the courts of England and Wales.
8.6 Nothing in these Terms and Conditions of Booking shall affect the rights of Consumers.
8.7 All clauses and sub-clauses of this Agreement are severable and if any clause or identifiable part thereof is held to be unenforceable by any court of competent jurisdiction then such enforceability shall not affect the enforceability of the remaining provisions or identifiable parts thereof in these Terms and Conditions of Booking.
